These Terms of Use ("Terms") govern the use of Myndel ("we", "us", "the Platform"), a digital loyalty card service operated from Finland. By using Myndel — whether as a shop owner or as a customer of a participating shop — you agree to these Terms.
Myndel operates as a software platform. The loyalty programmes themselves are operated by independent businesses ("Shops"). Myndel is not a party to the relationship between a Shop and its customers beyond providing the technology platform.
These Terms apply to two distinct groups:

Shop owners must create an account using a valid email address. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at hello@myndel.app if you suspect unauthorised access to your account.

As a Shop owner, you act as a data controller for your customers' personal data collected through Myndel. Myndel acts as a data processor on your behalf. By using the platform, you accept our Data Processing Agreement, which forms part of these Terms.
You are responsible for ensuring you have a lawful basis for processing customer data, including obtaining valid consent for email communications.
Myndel is currently free to use during early access. When paid plans are introduced, you will be given at least 60 days advance notice. Continued use after that date constitutes acceptance of the new pricing. You may cancel at any time before the effective date without charge.
When you register for a loyalty card through Myndel, you are joining a programme operated by the Shop — not by Myndel directly. Your loyalty stamps, rewards, and any associated benefits are subject to the Shop's rules.
Your loyalty card is accessible via a unique URL sent to your email address. This link is personal to you. You should not share it with others, as stamps and rewards are tied to your account.
Rewards are defined and managed by the Shop. Myndel does not guarantee the availability or delivery of rewards. If you have a dispute regarding a reward, you should contact the Shop directly.
By joining a loyalty programme, you consent to receive transactional emails related to your card (stamp confirmations, reward alerts, reminders). You can withdraw consent and delete your data at any time using the link in any email or the opt-out option on your card page.
Myndel and its content, features, and functionality are owned by Myndel and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our written consent.
Content you provide (shop name, logo, email templates) remains your property. You grant Myndel a limited licence to use it solely to provide the service.
We aim to keep Myndel available at all times but cannot guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of the platform with reasonable notice.
We may update these Terms from time to time. Material changes will be communicated to Shop owners by email. Continued use after the effective date constitutes acceptance.
To the extent permitted by Finnish and EU law, Myndel is not liable for:
Our total liability to any user shall not exceed the amount paid to us in the 12 months preceding the claim (or €100 if no payment has been made).
These Terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Helsinki, Finland, unless mandatory EU consumer protection law requires otherwise.
